3.1 Service Availability

We strive to ensure that our Service is available 24/7. However, we do not guarantee that the Service will be available at all times. The Service may be unavailable during maintenance periods, during technical difficulties, or due to factors beyond our control.

3.2 Service Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

4. License Key Access and Requirements

SafeCloakVPN does not require email accounts or passwords. Access is provided through a license key, which is used to activate and sync your subscription across platforms. You are responsible for maintaining the confidentiality of your license key and for all activities that occur under your license.

4.1 Account Eligibility

By creating an account, you represent and warrant that:

• You are at least 14 years of age.
• You have the legal capacity to enter into these Terms.
• You are not barred from using the Service under applicable law.
• The information you provide is accurate, current, and complete.

4.2 License Key Security

You are responsible for safeguarding your license key and for any activities or actions under your subscription. You agree to notify us immediately of any unauthorized access to or use of your license key. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

5. Subscription and Payment Terms

SafeCloakVPN offers various subscription plans. By subscribing to our Service, you agree to the following terms:

5.1 Subscription Plans

We offer weekly, monthly, and yearly subscription plans. The features, limitations, and pricing of each plan are described on our website and may be updated from time to time.

5.2 Payment

All payments are processed through third-party payment processors. Purchases in iOS and Android apps are handled by Apple App Store or Google Play. Purchases on the web or desktop are handled by Stripe. By providing payment information, you represent and warrant that you are authorized to use the payment method and agree to pay the subscription fee indicated.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each subscription period unless canceled before the renewal date. For Apple and Google purchases, renewal settings are managed in the App Store or Play Store. For Stripe purchases, renewal settings are managed through the Stripe billing portal linked to your license key.

5.4 Refunds

Refunds for Apple or Google purchases are governed by Apple and Google refund policies. For Stripe purchases, we offer a 30-day money-back guarantee for new subscriptions. Refund requests after this period or for renewal payments are considered on a case-by-case basis and are not guaranteed.

5.5 Price Changes

We reserve the right to change our subscription prices. Any price changes will be communicated to you in advance and will apply to the next billing cycle.

6. User Responsibilities and Acceptable Use

By using our Service, you agree to use it only for lawful purposes and in accordance with these Terms. You are responsible for all activities conducted through your account.

6.1 Compliance with Laws

You agree to comply with all applicable local, state, national, and international laws and regulations while using the Service. The use of our Service does not exempt you from adhering to applicable laws and regulations.

6.2 Multiple Devices

Our Service allows you to connect multiple devices simultaneously under a single license key. The standard device limit is 3 devices. You agree not to exceed the device limit specified in your plan.

6.3 License Key Sharing

Your subscription is for your personal use only. You may not share your license key with others or allow others to use your license. Subscriptions found to be shared among multiple users may be suspended or terminated.

7. Prohibited Activities

You agree not to use the Service to:

• Violate any laws, regulations, or third-party rights.
• Engage in any activity that could harm, disable, overburden, or impair our servers or networks.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems or networks connected to the Service.
• Use the Service for spamming, phishing, or distributing malware.
• Harvest or collect user information without consent.
• Engage in any fraudulent activity or impersonate any person or entity.
• Use the Service to transmit any material that is defamatory, obscene, or otherwise objectionable.
• Resell, lease, lend, share, distribute or otherwise transfer your subscription or rights to use the Service.

8. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of SafeCloakVPN and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

8.1 Trademarks

The SafeCloakVPN name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SafeCloakVPN or its affiliates or licensors. You may not use such marks without the prior written permission of SafeCloakVPN.

8.2 User Content

You retain any and all rights to any content you submit, post, or display on or through the Service. By submitting, posting, or displaying content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute such content in connection with providing the Service.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

9.1 Termination by User

You may terminate your subscription at any time by canceling in the App Store, Play Store, or Stripe billing portal (for web/desktop purchases), or by contacting customer support. Upon termination, your right to use the Service will cease at the end of the paid period.

9.2 Effects of Termination

Upon termination of your account, your right to use the Service will immediately cease. If your account is terminated due to a breach of these Terms, you may not be entitled to any refund of prepaid fees.

10. Limitation of Liability

In no event shall SafeCloakVPN, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use, or alteration of your transmissions or content.

Our liability is limited to the maximum extent permitted by law. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, our liability shall be limited to the maximum extent permitted by law.

Neither SafeCloakVPN nor its suppliers and licensors make any warranty that:

• The Service will meet your requirements;
• The Service will be uninterrupted, timely, secure, or error-free;
• The results that may be obtained from the use of the Service will be accurate or reliable;
• The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations; and
• Any errors in the Service will be corrected.

12. Indemnification

You agree to defend, indemnify, and hold harmless SafeCloakVPN, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
• Any claim that your use of the Service caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of the Service.

13. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the jurisdiction where SafeCloakVPN is incorporated, without regard to its conflict of law provisions.

13.1 Dispute Resolution

Any dispute arising out of or relating to these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the rules of the arbitration institution in the jurisdiction where SafeCloakVPN is incorporated. The number of arbitrators shall be one, and the language to be used in the arbitral proceedings shall be English.

13.2 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
